The claimant was injured while lifting a case of beverages to place on the shelves, when he felt a sharp pain in his back and fell. Despite the incident being witnessed by the store owner, the insurance company denied the claim. Months after the case was already in litigation, the insurance company obtained a Defense Medical Examination, with a doctor ‘generously’ paid by them. Even that doctor agreed there was a work injury – though he defined it as a soft tissue sprain and strain. Claimant’s doctors diagnosed a much more severe injury. The defense doctor claimed the sprain and strain was resolved, and the ongoing pain – which he admitted was real – was attributed to aging. The insurance company kept fighting. As it neared time for the judge to make a decision, the defendant knew they had little chance to win, but hoped the delay had worn down the claimant, and that he would accept a low settlement, far below the “true” value. Attorney Schmidt discussed all the options with the claimant, who agreed to keep fighting, unless the insurance company offered a fair deal. The settlement reached paid all past due benefits, plus almost three years of future wage loss.
